Understanding the Nullity of Marriage: Laws and Punishments in Nepal

Marriage is an important social institution that has its own legal framework in different countries. In Nepal, there are two types of marriage - void and voidable. The nullity of marriage is an essential aspect that needs to be studied to avoid any legal complications.

In Nepal, to get married, both the bride and groom should have attained the marriageable age as per the law. According to Nepalese law, both male and female should be at least 20 years old to get married. However, in India, the legal age for marriage is 18 for females and 21 for males.

Previously, the age for marriage in Nepal was 18 with the consent of the guardian; otherwise, it was 20. Child marriage is a punishable offense in Nepal, and the offender can be imprisoned from 6 months up to 3 years and fined from one thousand to ten thousand rupees. If a girl's marriage is done before she turns 14, the person who does or causes to do it can be imprisoned for from 3 months to one year and fined 5000 rupees. If a girl's marriage is done between the ages of 14 and 18, the doer of such marriage and the person who causes it can be imprisoned up to 6 months and fined up to 10,000 rupees or both. If the marriage of a male and female not attaining the age 20 was done or caused to do it, the person who does it or caused to do it can be imprisoned up to six months and fined up to 10,000 rupees.

It is essential to understand that child marriage is illegal in Nepal, and if anyone is found guilty, they can be imprisoned for up to 3 years and fined up to 30,000 rupees. Any marriage not entering the age of 20 is considered a punishable or void marriage and will not get legal recognition. In such cases, either party can annul the marriage.
