What Makes Court Marriage in Nepal Legally Valid?

A court marriage registered at any of Nepal's 77 District Courts creates a legally binding civil union recognised both domestically and internationally. Under Section 70 of the Muluki Civil Code 2074, both parties must meet four conditions: mutual consent to accept each other as husband and wife, minimum age of 20 years, unmarried status at the time of registration, and no prohibited blood relationship as defined by Nepali law. Once registered, the District Court issues an official marriage certificate in Nepal that serves as legal proof of your marital status for immigration, visa applications, property rights, and inheritance claims.

Nepal is not a member of the Hague Apostille Convention. For international use, your marriage certificate must be attested by the Ministry of Foreign Affairs (MOFA) and then legalised by the embassy of the country where you intend to use it. Who Can Register a Court Marriage in Nepal?

Nepal's marriage law is open to all nationalities. Nepali citizens, Non-Resident Nepalis (NRNs), Indian nationals, and citizens of any other country can register a court marriage here. For Nepali couples, the process requires a single status certificate (unmarried certificate) from the local Ward Office, citizenship certificates of both parties, and two witnesses. Foreign nationals must bring a valid passport with visa, a No Objection Certificate (NOC) from their embassy in Nepal, and proof of 15 days of continuous residence from the local Ward Office. Indian nationals marrying in Nepal follow the same foreign national process and must obtain their NOC from the Indian Embassy in Kathmandu.

Unlike India's Special Marriage Act, Nepal does not require a 30-day public notice period before the marriage can be solemnised. This makes Nepal a preferred destination for inter-caste, inter-faith, and international couples who want a straightforward, legally recognised marriage without lengthy waiting periods or public announcements.
